It is important to us that our services are reliable and transparent. That is why we treat your personal data with care and discretion and comply with all the applicable laws and regulations every time we process your data. In this Privacy Statement, we explain which data we collect, for what purposes and on the basis of which legal grounds. We do this based on the various ways with which we collect personal data. We will also explain how long we will process your personal data and what your rights are in reference to each instance of processing. We will also provide more information about the parties we work with as well our Security Policy.

 

The private company BARTS B.V. ("BARTS", we, "us"), legally established in Amsterdam, processes personal data. In this Privacy Statement, we explain which personal data we process, on the basis of which legal grounds and for what purposes.

 

Article 1         What terms are used in this Privacy Statement?

 

The terms below are defined as follows in this Privacy Statement:

 

§   The "DDPA", the Dutch Data Protection Authority.

§   "You/your/yours", the person (data subject) whose personal data BARTS processes.

§   "Personal data", any information that can directly/indirectly relateto you and/or lead to you, such as your name and (e-mail) address.

§   The "GDPR", the General Data Protection Regulation.

§   "Process", "Processing", every action that concerns personal data, including storing, collecting, organising, editing, using, consulting and deleting.

 

Article 2         What party is the Data Processor - the party responsible for the processing of personal data?

 

BARTS is, as the Data Processor, responsible for the processing of personal data. BARTS determines the purposes and means of the processing. This means that, on the grounds of the GDPR, BARTS is responsible for the personal data of yours that we process.

 

Article 3         To whom does this Privacy Statement apply?

 

This Privacy Statement applies to:

 

§  Persons who buy products from BARTS on the web shop

§  Persons who visit the website of BARTS (www.barts.eu)

§  Contact persons of (business) clients, including suppliers and buyers

§  Persons who receive the newsletter or other marketing messages from BARTS

When entering into an employment contract or an order agreement between you and BARTS for a position on BARTS team

In addition to the personal data that BARTS processes or may process when you apply for a position on BARTS team, BARTS may also process the following additional information:

 

§  Information from the identity document, including date of birth, place of birth, civil status, nationality, citizen service number, residence permit, work permit;

§  Financial information, such as a bank account number

§  Other information related to personnel, salary and absence registration

§  Other data which requires processing in the context of the applicable laws and regulations.

 

4.6       Persons who have sought to make contact with BARTS by e-mail, telephone or the contact form available on the website or other persons whose personal data we process.

Article 5         On what legal grounds and for what purposes does BARTS process your personal data?

 

5.1       BARTS processes your personal data on the basis of one or more of the following legal grounds according to the GDPR: 

§  When this is necessary to execute an agreement whereby you  are one of the parties or if you request to enter into pre-contractual negotiations

§  When this is necessary to fulfil a legal obligation of ours

§  When this is necessary for the representation of our justifiable interests or the justifiable interests of a third party

§  With your consent.

 

5.2       BARTS processes the personal data stated in Article 4 of this Privacy Statement for the following purposes. The legal grounds according to the GDPR are stated for each purpose:

Article 6         To whom does BARTS provide your personal data?       

 

6.1       BARTS provides your personal data to one or more of the following parties:

If you are a business client:

 

§  Other business clients, including suppliers and buyers

§  Sales partners

If you are part of BARTS team or will soon be joining the team:

 

§  The insurance company

§  The company physician

§  The pension fund

§  Auditors, in connection with certification purposes

§  Third parties, who, at our request, process personal data and who can be designated as "processors" under the GDPR, including: our (web) hosting company

§  Other parties, including government agencies, administrative bodies, authorities and supervisory bodies.

 

6.2       BARTS does not provide your personal data to other parties than stated above, unless it is necessary on the grounds of a legal obligation or when you have given consent to provide the data.   

 

6.3       BARTS does not sell your personal data to third parties.

 

Article 7         Security and the websites of third parties

 

7.1       BARTS has taken appropriate organisational and technical measures to protect your personal data as best as possible against unauthorised or illegal processing against loss, destruction, damage, change or publication, including data leaks. If you have any questions about the protection of your personal data or if you suspect that misuse is being made of your personal data, please contact us. Our contact information is stated in Article 13 of this Privacy Statement.

 

7.2       As defined by the GDPR, BARTS has concluded a processing agreement with its "processors".

 

7.3       The website of BARTS contains links to websites and/or applications of third parties. BARTS is not responsible for the websites and/or applications of third parties and how they handle your personal data. We recommend that you consult the applicable Privacy Statements of these third parties carefully.

 

Article 8         Processing the personal data outside the European Economic Region (EER)

 

Initially, BARTS processes your personal data only within the EER. If personal data is provided to a country outside the EER, BARTS shall ensure appropriate measures to guarantee that the provision of personal data takes place in accordance with the GDPR.

 

Article 9         How long does BARTS store your personal data?

 

9.1       BARTS stores your personal data in a form with which BARTS can identify you no longer than necessary for achieving the purposes stated in this Privacy Statement.

 

9.2       More specifically, BARTS uses the following storage periods:

 

§  For persons who receive the newsletter or other marketing messages from BARTS:

 

Until you unsubscribe from the newsletter or revoke your consent to receive other direct marketing messages from BARTS. Once you have unsubscribed from the newsletter or revoked your consent, your personal data shall be removed from our systems within 30 days.

 

§  For persons who have applied for a position on BARTS team, but who have not entered into an employment contract or and order agreement:

 

BARTS shall store your personal data for up two weeks after your application procedure has finished.

 

9.3       After the (statutory) storage periods, your personal data shall be destroyed. The (statutory) storage periods may change.

 

9.4       The above periods do not apply in the event BARTS is faced with a legal obligation to store the personal data longer or if this is necessary for the preparation and/or substantiation of a legal claim. 

 

Article 10      Your privacy rights

 

10.1     You have the following privacy rights in regard to the processing of your personal data on the part of BARTS:

 

§  The right to access the personal data of yours that BARTS processes

§  The right to edit or correct your personal data, forexample, if the data is incorrect or incomplete

§  The right to object to the processing of your personal data if you do not agree with how we process your personal data. This right applies to the personal data that we use for direct marketing.

§  The right to limit the processing of your personal data in some cases

§  The right to transfer your personal data to yourself or a third party ("the right of data portability")

§  The right of removal of your personal data ("the right to be forgotten")

§  The right to revoke your  consent for the processing of your personal data if the processing is based on your consent. This also includes your right to unsubscribe from receiving our newsletter or e-mails from BARTS. Revoking your consent does not change the legality of the processing of your personal data prior to revocation.

 

10.2     In order to exercise your rights, you need to contact us by way of the contact information provided in Article 13 of this Privacy Statement.

 

10.3     We will let you know within one month's time after receipt whether we can fulfil your request(s). This period may be extended by a term of two months in exceptional cases. We will inform you about this extension period by e-mail within one month after receipt of your request.

 

10.4     It is possible that we may not be able to (completely) fulfil your request(s). If we (partially) deny your request(s), we will always explain why.

 

10.5     In order to prevent that we provide information to the wrong person, we may ask for additional information from you so that we can establish your identity. Please do not ever send us a copy of your identity document if we have not requested it.
